well i've found out some more info. the policeman is part of the training team who escorts new recruits. Him and a new recruit were walking when i drove past and he says i was holding the phone in my hand by my leg. his trainee backs him up. no photographic evidence just what him and his collegue think they saw. Crap in it

You have to get the Police version of events in writing first, so they can not change the 'slant' on the story.
They you know exactly where you stand.
Also, hold your mobile down by your leg in your van, and get a mate to take photographs as you drive past. If it is clear that you can not see the mobile, then send the evidence to the Police and ask them to drop the case.

If as previously said they have written to the company secretary you should ignore the first letter then leave your response to the second letter for as long as possible then write back saying you are unsure as to who was driving the vehicle on that particular day and ask them to provide photographic evidence so as to help you identify the guilty party .As previously said 9 times out of 10 they cant produce the evidence and will write back saying they will drop it this time but in future a company director will be expected to take the points and pay the fine .It does sound like someone is having a wind up with you how many coppers do you know would come round to post you a letter and how would they know where you live? If it is registered to u as the keeper they wouldnt have adressed it to the company scretary and as said earlier who knows what you could have been looking down at.for all they now u just had a wet sneeze and you were wiping it off your leg!!!!!. good luck with it anyway keep us posted as to how u get on.Youd think they would find some real criminals to catch!!!!:

Would't this give them the evidence that they needed? Even if you weren't using your phone the first time (not that I'm saying you were!), this would prove that you certainly were the second time ! Just IMHO. Anyway, I'm sure you probably had someone else in the car/van with you, who can confirm that you were scratching your leg or something, didn't you ?
God luck - the whole thing stinks to me. Motorists - easy pickings for extra tax!

the letter was addressed and delivered to the company not me. Its obvious that he was training the new recruit and thats why it was all done so quickly.
JBD got a written warning at work once cus his boss had to do it for training so the first person that did the slightest thing wrong was picked on.

He didn't have to do it he just wanted some evidence for his NVQ in management. I found out later, after he'd left, from one of the other managers who was also did the same NVQ but found other ways to prove he understood how to discipline staff . And for the record I didn't actually do anything wrong, he just wanted the Mr Rob 20 minutes style of working. If you go back and read the original 20 minutes water pressure gauge post I believe my old boss gets a mention.

I just caught on this charge too. Take it to court and if they saw you using your phone they should be able to describe it. if they can't how can they prove it wasn't anything else you were holding, sunglasses case, case holding medicine/pills.

You could go to court and say it was your phone you were holding and you were just checking the time as the clock in your car is analogue (which it is in Burty's mondeo) and you're not used to them as you've allways had a digital clocks/watch's. So when looking at the analogue clock you have to think about it and figure it out which is means you're not concentrating on your driving. Sorted, case closed, not guilty!!!
