i cant see how this can stand up however it is maritime law you are dealing with (mostly totally outdated). all boats sit differently in the water at different speeds with different weights with tides and wind adding to the equation not excluding trim positions of tabs, outdrives, outboards etc we all know this including him. As for someone else driving i bet that comes under the same scenario of a company car where if the driver does not come forward - be identified, the company owner ends up with the points-fine. Fight it all the way and keep us posted. The very best of luck to you.

in motoring law a paragraph states '' the word of one policeman against you is insufficient evidence to prosecute in the absence of any factual speed readings''.........cant remember which actual law , but i did research it in order to defend myself...plead not guilty and fight it brother...

I suspect the time limit for the institution of proceedings in this offence is 6 months?
If so the summons have been issued at the last minute.
What have they been doing with the paperwork in the meantime??? This should have been done and dusted months ago.
Its not as though there is much to do in the way of gathering evidence to prosecute a case like this.
Many years ago in a different life when I regularly prosecuted various offences what we had to be aware of was, in legal terms, "abuse of process"...basically hanging about and doing nothing until the last minute and then rushing to beat the deadline by which time the offence was stale. It happened all the time with staff keen to do the exciting booking stuff but needing prodding time after time to do the paperwork afterwards, and I reckon thats what has happened here. Highly unprofessional and frowned on by the courts, and possibly your get out of jail free card...but of course take legal advice from someone who really knows what they are talking about

After many many years of amazing boating experiences and fantastic days out in Lymington and the solent in various different boats i have owned (I love it there) last June I too came under the hammer from the new HM and Co...... I turned up there in my new race boat all proud and couldn't wait to get it in to the water. The Life boat crew all came out and was admiring it and in awe of it. I had a really good chat with those amazing guys, I am in awe of them! Well the rest of the sailing or the opposite yachting crowds were shaking their heads and giving the looks of total disgust! (it is a real shame as it was never like that until about 5ish years ago, everyone got along then)They made it as humanly difficult as possible to block the slip way and obstruct it so i could not get in to the water, also making my partner feel very un easy with all the dirty looks and un welcome nasty sarky comments......(she refuses to and will not go there anymore because of their attitude!) Anyway it was a beautiful day and i was not going to let them spoil it. I got the boat in the water and off we chugged, Had a great day out in the solent, had lunch on the iow, it was getting late, well about 6 ish, we had a great time so we headed back to Lymington to call it a day. I crossed over at about 50 ish (as she does not like going fast) and proceeded in to Lymington waters. There was not a boat in sight all the way over or going in or out of Lymington so a very lonely chug in. As i got in to the 4knt entrance and headed to the pontoon i was greeted by the HM'S crew who went totally mad telling me i came past the jack in the basket at well over 30knots!!!! Well i just kept calm and listened and accepted my severe bollocking whilst my partner was starting to blow here top and fired back the reply and correct one of "No we were certainly NOT"(she had been out many many times with me before, we did nothing different that the usual). I could see it was going nowhere so i accepted my telling off and a few weeks later a written warning came through the post! By reading other and it seems this is very common now, I was lucky to get a written warning, so i must thank them for that!!!!!!!!!!!!!! While i was in the car park strapping the boat on the trailer there were about 8 guys with 3 power/raceboats laughing and calling me a "BAD BOY" and laughing.... They told me the same thing had happened to them a few weeks earlier! and also to friends of theirs too! and the HM and co are out for all of us. They and my partner all said my cards were marked as soon as we turned up with that boat. So you are totally right, If you turn up there with something that looks fast or very fast be careful!!!!!!!! VERY!!!!!!!!!!!!!................................. .................................................. ...
Well as my partner will not go there anymore because of the way she is made to feel very uncomfortable by the sailing or yachting community i go there with my mates now, they like to go fast and so do i, I love blasting flat out in the solent with my OFFSHORE leg and my fully tuned Merc! I have since called all of the HM's in the whole of the solent and asked them all about speed limits in every area and where all their waters end.
A couple of weeks after my so called offence i was back down there and right infront of my eyes a small digny came past the pontoon at some 12 to 15 mph in the 4 knot zone.... the very same HM'S co that bollocked me were standing there! They called them in, told them off and sent them on their way without any details being taken, no written warning to come or anything! Of course i have seen many many since and NOTHING has been said!!!!
I have sailed, crewed and raced on yachts... I enjoyed it but it is not my thing. My friends race their yachts and win races like round the island and everything else down there, they are great guys and also like the speed of powerboats!!! Why should we be subbed at and victimised just because we have a powerboat????? It is a choice.... We get along with everyone but they (Not all of them) don't!!!!! SADDDDDDDDDD people who need to get a life and let others get on with theirs.

Sorry for going on about it but i have kept quiet for many many years but now i am not.
Well i am now armed with a quieter 300xs with GPS and Troll and 2 cameras.... So let’s see what happens now!!!

MY ADVISE TO ALL OF YOU IF YOU ARE GOING TO USE THAT RIVER IS TO MOUNT A CAMERA ON THE FRONT AND ON THE BACK OF YOUR BOAT AS I DO AND TURN IT ON FOR THE WHOLE TRIP OUT AND BACK IN!!!!!
I have now gathered quite a good library of serious offenses committed by the sailing/yachting fraternity including blocking the whole of the harbour shipping lane from the 6kt to the 4 kt speed zones all the way in and including most of them on the wrong side and heading towards an oncoming ferry!
If you want this to take to court you are more than welcome. It is in Hd too!
There will be about 50 or so fines from this footage!
What about being on the wrong side heading towards the ferry!

Just 2 more things:

Funny how it is that when they get in trouble who comes to rescue them????
A POWERBOAT FULL OF VERY BRAVE HEROS!!!!
ALSO AS THEY HAVE PISSED MY PARTNER OFF SO MUCH SHE WILL NOT GO THERE ANYMORE, (SO BOATING IS OVER FOR HER UNLESS I GO SOMEWHERE ELSE) HOW IS IT THAT THEY CAN TRY AND INTIMIDATE 3 burly guys with a flashy powerboat and think that is ok????? Good job we are all gentleman and all grown up or they would be in serious trouble.
They just need to GROW UP TOO!!! I think that is a VERY VERY tall order..
Well guys, let’s not let them spoil our only pleasure in life, we have grown up, we can take it on the chin, we will keep building our HD VIDEO EVEDENCE and maybe one day we will put it all together, club together, get them all done and get our or your convictions QUASHED and with interest.

Lymington.......lol, coupe of summers ago a group of us went in the harbour for some fuel ( 3 jet skis ), it was surreal , lots of frowns from the locals, the fuel berth refused to serve us ( a yachts crew also on the berth were as bemused as we were ) and we got escorted out of the area by the harbour safety rib - 'your not welcome here!!!' As we left the inner harbour breakwater under escort abiding the speed limits pretty much everything with a sail was overtaking us, some racing dinghies were ripping though there, I pointed this out to mr harbour safety boat and he didn't comment. Turns out pwc's are banned from lymington waters. I got hold of the harbour master the following day, I was annoyed because we were turned away for fuel, nobody asked or knew how low we were, potentially putting us in danger, the harbour master did apologise and agreed it was unacceptable not to serve us, although any pwc's in future wanting fuel would either be towed or escorted in and out of the harbour limits , happy days!

i feel that as they have found out i'm also the manufacturer of my boat they can hang me up as an example to others.
probably think i can afford the court costs and fine.
ive spent 3 1/2 yrs and my health to create what we do at voodoo and not not earnt a penny from it

Lmington slip

Not had any problems with the HM ,having said that i haven't been there recently because of the aggro with the sailing dinghies on the slip.They seem to think it is theirs and theirs alone by the way they arrogantly treat other users , particularly powerboats.
I had a tube on my rib marked by two lads dragging their dinghy past,it was an accident and the lads apology was accepted only to then hear their dad tell them 'there is no need to apologise to him '.He was left in no doubt what i thought of his attitude.
There should be room for both to launch and recover together yet i have witnessed on numerous occasions dinghy trailers left on the slip and landing /derigging behind launching powerboats , who were there first,when there is room either side.They won't move when asked either.
Maybe he should have a look at this behaviour as well.Or is that like biting the hand that feeds him !
As you can see this thread has touched a raw nerve.

when i used to boat out of lymington with a rib the h/master ws so friendly ,a rib is deemed ok it seems.then i turned up in an extreme with a burbling 496 and got a bollicking for speeding on tick over and they blanked me from then. happy days

That (as sad as it is) seems to be the attitude there.
It was never like that before. There is pleanty of room for all to go about their duties. If any laws or enforcement is needed then it has to be on the slipway!

V8 on open pipes!!! Get it down there! lol...
PCM yes i do remember very well.. I had a good look at your gorgeous boat.. I think it was your friends in the car park that i was talking to after..

I will pm you details of the footage..

I still think a mass launch day is on the cards! or some rules and regulations need to be sorted out on the slipway, I will read the harbour regs and see if anything is in it about this...

This from the Lymington Harbour Commissioner's website might be helpful.

To avoid delay and inconvenience to others, particularly at busy times please prepare your boat and rigging away from the slipway. Do not bring your boat to the slipway until you are ready to launch. Well rules are rules and laws are laws.... everyone should respect that and not just us powerboaters who are polite and try and keep the peace!
I thought there would be some rules in there!
I think the HM and Co should be made aware of these rules and enforce them as they should be!
Ah maybe they have not read the Lymington harbour byelaws!
they have just made their own up saying "Any powerboat, flash boat, race boat or anything that looks fast give maximun grief and abuse to and make sure you do them as we don't want them here"
Oh V8 on open pipes keeps coming to mind!
They had better pray i don't win the lottery or a twin turbine 50 ft cat will be going up and down all day long at 4 knots with the throttles on full chat!!!!!
