Liquidate and ascertained damages cannot be punitive but merely reflect the loss suffered by the client, Should you wish to become a client of my Firm then a non returnable deposit of, shall we say £55,000 is required this will aid in the completing the project and should the project run late then you could demonstrate a loss. If you are not a client there cannot be liquidated damages
A Domestic subcontract would not be applicable, so I could draft a document that would be acceptable to myself..
OR IS IT SPONSORSHIP YOUR OFFERING FROM YOUR ESSEX COMPANY???

Firkin el it's gone all contractual before we've even discussed 'the deal'
Anyways as you know I'm a firm believer that contractual matters should be thrashed out by the minions before stepping in for the glory moment, I therefore suggest we meet up on the boat next weekend, introduce the two wifes with a brief explanation of what's expected of them, then feck off down the pub till they've thrashed it out

The Programme is achievable with hard work and good weather this winter, would love to find undercover storage for her so she could be worked on every weekend but for a 41 footer thats about as rare as hens teeth
The biggest pondering items are the engines, definately going to be Big Block EFI's just a matter of finding the "Right" pair at the "Right" price, Next is the Steering System What to go for Make model etc, havent got a clue at the moment but searching google and other sites for advice on that matter.
Aparently when she was racing she had 4 Fuel tanks, two forward of the cockpit and two either side of the cockpit, got the two which go either side of the cockpit but the other two? god knows where they are. Also I believe she had a ballast tank up front but again god knows where that is!
If anybody knows where I could get hold of the original build spec or drawings that would help no end with the restoration project.

Graham Stevens is your best bet. He worked at the Don Shead design house around the period that boat was built.

As I have said before one of my favourites, watched this boat race loads of times from a kid and later on, on the odd occasion lined up on the start line with it, most of the time it raced it finished and finished first in class or 1st overall a testament to those sabre marathon deisel engines of their day and it appeared whoever challenged it always came unstuck in fact the only boat I recall that could kick it's ass rough or calm and in the rough only just was a winged Buzzi 38 with 1500hp... see discussion OSO thread it's really interesting hearing the guy ( habanajoe ) talk about these boats and he brings into the thread about the Plantec which he raced against back in the day he also talks about the famous Cesa that he raced in, he asks for help on this boat so I posted ( aquafun ) although my Knowledge on this boat is not a patch on many people's on this forum like Jf's

I had an amazing meeting this afternoon with Graham Stevens who used to work in the Don Shead Design House, Apart from being a font of knowledge and having a Library of Historical Boat Racing facts, figures and pictures he has kindly lent me a set of Working drawings of "ABO" (Double 2 Shirts in a past life) to get copied. So I can now get "Lost" parts re-made to the original spec...
I would publically like to thank Graham not only for his time and unbounded knowledge but for trusting me with his prized drawings - Thank you Graham

In order to implement this implied contract term one must be "Reasonable" in the timescale applicable to the term on which you rely! The drawings are in imperial not metric so for young guns like oneself we have to take our socks off to count to 12. This is clearly unreasonable therefore the Unfair Contract Terms and Conditions Act 1977 (As amended 2006) takes president!
