The buyer received a FULL REFUND and still proceeded with Negative feedback.. Hence Deformation of Character simple..

If no refund was forthcoming then the buyer could demonstrate a LOSS but as no Loss was incurred why no simply put "Item not exactly as described but full refund given thank you" possibly would have been better !!

The man who holds the record for the most Libel Cases running at one time in the High Court was Robert Maxwell apparently he would issue proceedings at the drop of a hat...

Read that as well, however I still think many ebay users wont care, many have nothing to lose you cant threaten someone with court action if they just don't care

Feedback is there to let others know what buyers and sellers are like. The seller misdiscribed his item and the buyer was letting others know although, as a fair feedback, I agree that he should of added refund given but it should of still been neg feedback. without some form of neg feedback, how should others know that this seller misdiscribes items?

Robert Maxwell may have the record for the most cases of libel action but look were he ended up.
